PushForm ist eine App zum Zählen und Verfolgen von Liegestützen. Mit der Nutzung der App stimmst du diesen Bedingungen zu.
PushForm ist ein Fitness- und Trainingshilfsmittel und kein medizinisches Produkt und kein medizinischer Rat. Trainiere im Rahmen deiner Möglichkeiten und auf eigene Verantwortung. Hol im Zweifel oder bei gesundheitlichen Beschwerden ärztlichen Rat ein, bevor du mit dem Training beginnst.
Die Kamera wird ausschließlich in Echtzeit auf dem Gerät zur Erkennung der Liegestütz-Bewegung verwendet. Es werden keine Bilder oder Videos aufgenommen, gespeichert oder übertragen. Details in der Datenschutzerklärung.
Die automatische Zählung per Kamera, Schätzungen (z. B. Kalorien) und Trainingspläne beruhen auf technischen Verfahren, die naturgemäß variieren können; eine absolute Fehlerfreiheit können wir daher nicht garantieren. Deine gesetzlichen Gewährleistungsrechte bleiben hiervon unberührt.
Für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie bei Vorsatz und grober Fahrlässigkeit haften wir unbeschränkt nach den gesetzlichen Vorschriften. Bei leichter (einfacher) Fahrlässigkeit haften wir nur bei der Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht), deren Erfüllung die ordnungsgemäße Nutzung der App überhaupt erst ermöglicht und auf deren Einhaltung du regelmäßig vertrauen darfst; in diesem Fall ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt. Im Übrigen ist die Haftung für leichte Fahrlässigkeit ausgeschlossen. Zwingende gesetzliche Regelungen (z. B. nach dem Produkthaftungsgesetz) bleiben unberührt.
Die App, ihr Quellcode, ihre Inhalte und ihre Gestaltung sind urheberrechtlich geschützt. Eine Nutzung außerhalb der gesetzlichen Schranken bedarf unserer Zustimmung.
Die Nutzung der App ist ab 16 Jahren zulässig. Minderjährige benötigen die Zustimmung der/des Sorgeberechtigten.
Die App wird über den Apple App Store bereitgestellt; ergänzend gilt Apples Standard-Lizenzvereinbarung für Endnutzer („Licensed Application End User License Agreement"). Apple ist nicht Vertragspartner dieser Bedingungen und für die App nicht verantwortlich.
Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen und berechtigt, sie dir gegenüber durchzusetzen. Apple übernimmt keine Gewährleistung, keinen Support und keine Wartung für die App; jede Verantwortung für die App trifft allein uns als Anbieter. Etwaige Produkthaftungs- oder sonstige Ansprüche im Zusammenhang mit der App sind uns gegenüber geltend zu machen, nicht gegenüber Apple. Du sicherst zu, dich nicht in einem Land aufzuhalten, das einem US-Embargo unterliegt, und auf keiner US-Sperrliste zu stehen.
Es gilt das Recht der Bundesrepublik Deutschland. Handelst du als Verbraucher mit gewöhnlichem Aufenthalt in einem anderen Staat, bleibt dir der Schutz erhalten, der dir durch die zwingenden Bestimmungen des Rechts deines Aufenthaltsstaats gewährt wird (Art. 6 Abs. 2 Rom-I-VO).
Du kannst die Nutzung der App jederzeit beenden, indem du sie löschst.
Werden diese Bedingungen aktualisiert, ändern wir das oben genannte Datum.
Wir sind nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen (§ 36 VSBG).

PushForm is a fitness and training aid and is not a medical device and not medical advice. Exercise within your abilities and at your own risk. If in doubt or if you have health concerns, consult a physician before starting to train.
The camera is used only in real time on-device to detect the push-up movement. No images or video are recorded, stored, or transmitted. See the Privacy Policy for details.
Automatic camera counting, estimates (e.g. calories) and training plans rely on technical methods that may naturally vary; we therefore cannot guarantee they are entirely error-free. Your statutory warranty rights remain unaffected.
For damage to life, body or health, and in cases of intent or gross negligence, we are liable without limitation under the statutory provisions. In the case of slight (ordinary) negligence we are liable only for the breach of a material contractual obligation (cardinal obligation) whose fulfilment makes the proper use of the app possible in the first place and on whose observance you may regularly rely; in that case liability is limited to the typical, foreseeable damage. Otherwise liability for slight negligence is excluded. Mandatory statutory provisions (e.g. under product liability law) remain unaffected.
The app, its source code, its content and its design are protected by copyright. Any use beyond the statutory limitations requires our consent.
Use of the app is permitted from the age of 16. Minors require the consent of a parent or legal guardian.
The app is distributed via the Apple App Store; Apple's standard Licensed Application End User License Agreement applies in addition. Apple is not a party to these terms and is not responsible for the app.
Apple and its subsidiaries are third-party beneficiaries of these terms and entitled to enforce them against you. Apple provides no warranty, support or maintenance for the app; sole responsibility for the app lies with us as the provider. Any product-liability or other claims relating to the app must be asserted against us, not against Apple. You represent that you are not located in a country subject to a U.S. embargo and are not on any U.S. restricted-parties list.
These terms are governed by the laws of the Federal Republic of Germany. If you are a consumer with habitual residence in another state, you retain the protection afforded to you by the mandatory provisions of the law of your state of residence (Art. 6(2) Rome I Regulation).
You can stop using the app at any time by deleting it.
If these terms are updated, we will change the date shown above.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
